Restructuring, bankruptcy

The team led by Ewa Boryczko PhD copes with issues related to the restructuring, reorganisations and liquidation of business entities. We specialise in cross-border bankruptcy. We advise on mergers, divisions, transformations and restructuring proceedings

  • Restructuring

Restructuring of business entities is a complex and multi-aspect issue. Restructuring processes should be supported and supervised by the specialist of numerous branches of law such as labour law, commercial law and tax law. We perform our tasks in cooperation with financial advisors and experts in management systems modernisation and human resources optimisation. We advise on the choice of organisational and legal forms of activity that are optimal from the financial and tax point of view.
  • Bankruptcy, cross-border bankruptcy

We provide assistance to the business entities that are in a financial situation requiring the initiation of the restructuring or bankruptcy proceedings, as well as to the creditors claiming their receivables in the bankruptcy proceedings. Due to long-term experience we have become specialists in cross-border bankruptcy proceedings conducted on the basis of the Council regulation (EC) No 1346/2000 of 29 May 2000 on insolvency proceedings. In accordance with that regulation, the court of a given Member State may open insolvency proceedings with regard to the company whose seat is in another member state. Particularly, we provide assistance to receivers and administrators from other Member States appointed to perform that function before the companies with their seats in Poland.
